The Greffe du Tribunal d’Arras is an administrative department that supports the court in its mission to regulate commercial affairs, and is responsible for registering proceedings, managing files and keeping registers. Created in 1793, the associated court is responsible for settling commercial disputes between companies, as well as protecting creditors and merchants in difficulty. This department is therefore a key player in commercial justice in the Hauts-de-France region.

An essential role in processing files

The vital role played by the Arras Court Registry in the processing of cases cannot be underestimated. Indeed, this administrative department is responsible for all stages of the proceedings, from the registration of proceedings to the drafting and distribution of legal deeds, including commercial deeds (Porte B), for example for the creation of a company (see below). Registering proceedings is an important step in the process, as it determines the date on which the proceedings were initiated.

This date can have important consequences, particularly in terms of deadlines. It is therefore the responsibility of the Registry to ensure that all proceedings are registered on time.

A service that supports entrepreneurs

The Greffe’s mission is to inform entrepreneurs about the procedures for filing their applications, the deadlines to be met and the documents to be provided. As such, it is the first point of contact for entrepreneurs who have questions about their procedure. It provides them with clear, precise answers on the steps to follow. For example, you can file your articles of association and annual financial statements, and pick up your K-bis excerpts. The Registrar’s Office is also responsible for publishing legal announcements: this mission is essential to inform creditors and other economic players of the situation of the company in question.

Legal announcements guarantee the transparency and regularity of procedures. In the event of receivership or compulsory liquidation, the Registrar’s Office is also able to assist entrepreneurs in compiling their application file. It is important to emphasize that these procedures are complex and require precise knowledge of procedural rules. The Greffe can therefore provide invaluable support to entrepreneurs who find themselves in difficulty.

Last but not least, the Arras Greffe is able to provide information on business assistance and support schemes. In particular, it can direct entrepreneurs to the appropriate organizations for advice and financial assistance.

A public service mission and a service accessible to all

Ultimately, the Greffe is a public service responsible for managing commercial court files, and therefore plays an important role in the organization of commercial justice in the Hauts-de-France region. It works closely with the court’s consular judges to ensure that proceedings run smoothly. It also ensures compliance with procedural rules and deadlines, to guarantee the fairness and transparency of decisions. The service is accessible to all economic players requiring its services. Entrepreneurs can go directly to the Registrar’s Office to file their case, or request the assistance of a lawyer to support them in their proceedings.
